14-day right of withdrawal

For consumers (private individuals)

1. General Provisions

1.1. These sales terms apply to purchases made through the Datafox OÜ e-shop (hereinafter the “e-shop”) and form the basis of sales contracts concluded on the websites www.datafox.ee and pood.datafox.ee (hereinafter the “Website”).

1.2. The seller of the goods is Datafox OÜ, registry code 12519049, located at A.H. Tammsaare tee 47, 11316 Tallinn, Estonia, e-mail: shop@datafox.ee.

1.3. These terms apply to all buyers who make purchases in the e-shop.

1.4. Datafox OÜ reserves the right to unilaterally change and amend the sales terms by publishing the new terms on the Website.

1.5. By purchasing from the e-shop, the buyer agrees to the sales terms.

1.6. The sales terms have been drawn up in accordance with the legislation in force in the Republic of Estonia.

1.7. The sales terms and the sales contract are concluded in Estonian.

1.8. Datafox OÜ retains every version of the sales terms. These can be requested by sending an inquiry to Datafox OÜ.

2. Trading Environment and Conditions

2.1. The description of goods in the e-shop constitutes an offer.

2.2. Datafox OÜ has the right to set a minimum and maximum quantity for goods.

2.3. To conclude a sales contract, the buyer enters the required information, selects a delivery method and confirms the order.

2.4. The buyer pays for the goods and delivery, thereby accepting both the price of the goods and the delivery cost.

2.5. The sales contract is considered concluded upon payment for the goods.

3. Payments

3.1. Payment can be made via bank links (Swedbank, SEB, LHV, Luminor, Coop Pank, Citadele, Revolut, N26), by invoice, and with company credit. Payments are processed by Montonio Finance UAB. Payment takes place outside the e-shop in a secure environment – when paying by bank link, in the secure environment of the respective bank.

3.2. Credit and debit card (VISA, Mastercard) payments are processed by Maksekeskus AS. Payment takes place outside the e-shop in a secure environment – when paying by credit or debit card, in the secure environment of Maksekeskus AS. The seller has no access to the customer's bank or credit card details. For customers paying by credit or debit card (VISA, MasterCard) or using Apple Pay or Google Pay, a payment method service fee is added to the order total. The service fee is calculated automatically at checkout and displayed before the purchase is confirmed.

3.3. When paying by bank transfer (invoice), the customer must pay the invoice by transfer after placing the order. The invoice is sent to the customer after the order is confirmed, and payment must be made by the due date stated on the invoice. Order processing begins after the payment has been received.

4. Delivery Terms

4.1. Datafox OÜ e-shop delivery options apply to addresses across Estonia. Deliveries across the Baltics or further afield are arranged separately upon request.

4.2. Delivery prices in the Datafox OÜ e-shop are shown in the shopping cart and in the final step of checkout.

4.3. Heavy-cargo delivery applies to the Televisions category and to products weighing over 30 kg.

4.4. In the Datafox OÜ e-shop you can choose Omniva, DPD, SmartPost and Venipak parcel machines as the delivery method. We also offer an Omniva courier service — the goods are brought to your front door.

5. Hire Purchase

5.1. Datafox OÜ may offer hire-purchase options in cooperation with third parties. Hire-purchase terms are agreed individually. A service fee is added to hire purchase. The service fee is calculated automatically at checkout and displayed before the purchase is confirmed.

6. Prices

6.1. Prices are in euros and include VAT as required by law (unless stated otherwise). We reserve the right to withdraw from a contract concluded on the Website and not to ship the ordered goods if the price or quality of the goods in the e-shop was presented incorrectly, or the final price in the shopping cart was presented incorrectly due to a system error, and the difference from the correct price was more than 15%. We will notify you of the error without delay and immediately refund the purchase price using the same payment method you originally used. You have the option to buy the same goods at the correct price stated in the notice by adding the selected goods to the shopping cart again. In the case of such withdrawal, you are not entitled to claim compensation for any damage that may arise from the withdrawal.

7. Retention of Title

7.1. Ownership of the goods remains with Datafox OÜ until the purchase price has been paid in full.

8. Right of Withdrawal and Submitting Complaints

8.1. A consumer (a natural person not acting in the course of economic or professional activity) has the right to withdraw from the sales contract within 14 days of receiving the goods. To do so, the consumer must send an e-mail to shop@datafox.ee and submit an unambiguous declaration of intent to withdraw from this contract. The withdrawal application is considered submitted on time if you have sent the notice of exercising the right of withdrawal before the end of the withdrawal period.

8.2. The statutory 14-day right of withdrawal does not apply to business customers (a legal person or a natural person acting in the course of economic or professional activity).

8.2.1. Returns for business customers are possible only by mutual agreement between the parties, and the seller has the right to establish separate return conditions.

8.3. The goods must be returned in the original packaging, unused and undamaged.

8.4. If the consumer withdraws from the sales contract using the 14-day right of withdrawal, the direct costs related to returning the goods (incl. transport and postage costs) are borne by the consumer.

8.5. Datafox OÜ has the right to withdraw from the sales contract under certain conditions, for example if the goods cannot be delivered.

9. Warranty and Handling of Complaints

9.1. Datafox OÜ is liable for the conformity of the sold goods with the contract terms in accordance with the laws in force in the Republic of Estonia.

9.2. Complaints must be submitted within two months of discovering the defect.

9.3. In the event of potential non-conformity of the product with the contract terms, the consumer has the right to use all legal remedies provided by law and to file a complaint with the Consumer Disputes Committee operating under the Consumer Protection Authority, whose competence includes resolving disputes arising from contracts concluded between the consumer and the seller that the parties have not been able to resolve by agreement, provided that the value of the disputed product or service is 20 euros or more. Review of a complaint by the Consumer Disputes Committee is free of charge for the parties. In addition, the consumer may use the European Union online dispute resolution platform to resolve disputes arising from purchases made through the e-shop. 10. Exclusion of Liability for Third-Party Links

10.1. Our website contains links to other websites. The following applies to these links: the style and content of the linked websites are not under Datafox's control; Datafox is not responsible for the content of linked websites, and it is not Datafox content. This applies to all links and to the content of all linked websites.

11. Other Terms

11.1. All disputes will be resolved through negotiations where possible; if necessary, they will be resolved in court or by the Consumer Disputes Committee.

11.2. The Website and its content are the intellectual property of Datafox OÜ.

12. Privacy and Data Protection

12.1. Datafox OÜ confirms that all personal data is processed in accordance with applicable data protection regulations.
